Following the Court of Appeal’s decision to dismiss UNISON’s appeals against its judicial review applications challenging the introduction of tribunal fees, the Scottish Government has issued a paper, titled: ‘A Stronger Scotland: The Government’s Programme for Scotland 2015/16’ in which it has announced its decision to abolish tribunal fees. It is however unclear what the timeline is for abolition of the fees. The First Minister of Scotland, Nicola Sturgeon MSP, has however made a firm commitment to doing so. In the introduction to paper she states: “We will abolish fees for employment tribunals – ensuring that employees have a fair opportunity to have their case heard”. Unfortunately the UK government has given no such commitment and is unlikely to do so in the near future.
