Gross Misconduct Dismissal Overturned on Appeal

Situation:
An employee who had been dismissed for gross misconduct asked Henry to represent him at his disciplinary appeal hearing. The dismissal had serious implications for his career, and he strongly believed the decision was unfair.

Outcome:
As a result of Henry’s advocacy, the appeal panel agreed that the dismissal was not justified. Unfair Dismissal for Ill-Health Capability and Disability Discrimination

Situation:
An employee who was dismissed due to long-term ill health turned to Henry for help. She believed the dismissal was unfair and that her employer had failed to take her disabilities into account.

What Henry Did:
Henry represented her throughout the employment tribunal process. He carefully built a case showing that the employer had not only dismissed her unfairly but had also failed in its legal duty to make reasonable adjustments for her disabilities. He prepared the case for the employment tribunal which included gathering relevant medical evidence, drafting the claim form (Form ET1), preparing the hearing bundle and witness statements, and instructing an employment barrister to represent her at a full merits hearing.

Outcome:
The tribunal found that the employee had been unfairly dismissed and discriminated against due to her disabilities. She was awarded £60,000 for loss of earnings and a further £25,000 for injury to feelings. The judgment sent a clear message about the importance of supporting employees with disabilities, and the employee was able to move forward with financial security and her rights fully upheld.
